NOTICE OF ADOPTION, SUBJECT TO PERMISSIVE REFERENDUM,
OFANAMENDING AND RESTATINGBOND RESOLUTION OF THE
VILLAGE OF ELBA, GENESEE COUNTY, NEW YORK

Notice is hereby given that at its August 2, 2023 meeting the Village Board of Trustees of the Village of Elba (the “Village”) adopted a resolution that amends and restates a previously adopted bond resolution (dated March 16, 2021 and amended on May 25, 2022)for a sewer system capital improvements project in order to increase the estimated maximum cost of the project and the amount of serial bonds authorized from $987,850 to $4,414,000. Such amending bond resolution was adopted because of an increase in the cost of the project due to the receipt of higher than anticipated bids.Such project will generally consist ofa certain sewer system capital improvements project with the majority of the work to be located primarily at the wastewater treatment facility; such work to initially consist of the installation of an ultraviolet (“UV”) disinfection system including, but not limited to, improvements to the headworks facility and flow distribution structure, the installation of new aeration blowers and equipment, the installation of a new backup generator, replacement of effluent pumps and controls within wet wells, the removal of buried fuel tank, installation of new electrical distribution gear and other electrical improvements, installation of sidewalks and asphalt, by-pass piping modifications and water service, replacement of existing sanitary sewer with the installation of new PVC pipe, manhole rehabilitation and the installation of backup generators at each sanitary sewer pump station, and other minor and ancillary improvements associated with the improvements to the wastewater treatment facility, as well as other improvements more fully identified in (or contemplated by) a revised preliminary engineering report prepared by CPL (Clark Patterson Lee), including all preliminary work and necessary equipment, materials, and labor and all preliminary costs and costs incidental thereto and in connection with the financing thereof (collectively, the “Purpose”). The amended estimated maximum cost of the Purpose is $4,414,000. Such project cost will be offset by any federal, state, county and/or local funds received(including, but not limited to, the following funds anticipated to be received by the Village: a $3,851,250 Clean Water State Revolving Fund Loan and a $288,750 Water Quality Improvement Program Grant). Such amending and restating resolution is subject to permissive referendum pursuant to New York law.
